General terms of membership

These General Terms of Membership (hereinafter the ‘GTM’), corresponding to the French ‘Conditions Générales d’Adhésion’ (CGA).This English version is provided for convenience only and is a non-official translation. In case of discrepancy or divergence, the French version (“Conditions Générales d’Adhésion de la Société Française de Cosmétologie”) shall prevail.

PREAMBLE

The French Society of Cosmetology (hereinafter the “SFC”), an association governed by the law of 1 July 1901, registered with the RNA under number W922001007 and whose registered office is located at 210 boulevard Bineau – 92200 Neuilly-sur-Seine, admits members under the conditions defined by its Statutes and its Internal Regulations.

These General Terms of Membership (hereinafter the “GTM”) govern the relationship between the SFC and its Members, in addition to the Statutes and the Internal Regulations, which prevail in the event of contradiction. They may be amended at any time by decision of the General Assembly, in accordance with the Statutes, in order to take into account the development of the association and legal obligations.

Membership of the SFC is formalised by ticking the box “I have read and accept the General Terms of Membership”, available online during the membership process. This acceptance also entails acknowledgement of the Statutes, the Internal Regulations, the General Terms of Use of the Website (GTU) and the Privacy Policy of the SFC.

For the purposes of these GTM, the following terms shall have the following meanings:

  • “Member”: any natural or legal person admitted as a member in accordance with the Statutes of the SFC;
  • “Website”: the official website of the SFC, accessible at https://www.sfcosmeto.fr.

1. Responsibilities

The Member is solely responsible for the information, messages or data of any kind made available through the Website.

Any decisions taken by the Member on the basis of such information shall be under their sole responsibility.

The Member shall be held liable towards the SFC and any third party for any direct or indirect damage of any kind caused by a breach of their commitments to the SFC.

Consequently, the Member undertakes to indemnify and hold harmless the SFC against any claim or conviction arising therefrom.

The SFC shall not be held liable for direct or indirect damages resulting from membership or participation in the association’s activities, except in cases of gross negligence or wilful misconduct established against it.

Each Member is responsible for their own actions as well as those of the persons they authorise and guarantees the SFC against any claim or action from third parties as a result.

2. Contributions

The amount, method of determination and payment of membership fees are set by the Board of Directors in accordance with the Statutes (Article 14) and the Internal Regulations (Article 2).

3. Duration of Membership

Membership is concluded for the duration of the calendar year, from 1 January to 31 December.

Loss of membership occurs under the conditions provided for in Article 6 of the Statutes, in particular in the event of resignation, non-payment of the membership fee within the deadlines set by the Internal Regulations, removal for serious cause decided by the Board of Directors, or death.

4. Membership Review

The amount of the membership fee may be revised each year by decision of the Board of Directors, in accordance with the provisions of the Statutes of the SFC.

5. Withdrawal

Membership of the French Society of Cosmetology constitutes membership of an association governed by the law of 1 July 1901. In accordance with the Statutes and the Internal Regulations, the annual membership fee remains acquired by the association and shall not be reimbursed, even in the event of resignation, removal or death of the Member, unless otherwise provided by mandatory legal provisions.

When membership is concluded remotely by a natural person acting for purposes outside their professional activity (consumer), such person has a right of withdrawal of fourteen (14) days from the confirmation of their membership, in accordance with Articles L.221-18 et seq. of the French Consumer Code. In the event of exercising this right, the membership fee shall be refunded, less, where applicable, the amount corresponding to services already provided at the Member’s express request before withdrawal (Article L.221-25 of the French Consumer Code).

Apart from this statutory right, membership is final and binding.

6. Personal data

Personal data.

The protection of personal data is governed by the Privacy Policy of the SFC, available on the Website [link]. This Policy forms an integral part of these GTM. Each Member has the rights of access, rectification, objection, portability, restriction and erasure recognised by Regulation (EU) 2016/679, by writing to: rgpd@sfcosmeto.fr. The SFC implements appropriate technical and organisational security measures to protect the confidentiality, integrity and availability of data and exchanges carried out within the framework of membership.

Confidentiality of Information.

The information, documents and content made available to the Member are intended for strictly personal and internal use. Any transmission, reproduction or dissemination, in whole or in part, free of charge or for consideration, to third parties without the prior written consent of the SFC is prohibited. Breach of this obligation may result, without prejudice to possible legal proceedings, in the suspension or termination of membership, in accordance with the Statutes and Internal Regulations.

Member Directory.

As part of membership, the SFC establishes and distributes a Member Directory, in paper and digital format. This directory is exclusively intended to promote scientific, associative and professional exchanges between Members of the SFC.

Registration in this directory is based on the legitimate interest of the Association (Article 6-1 f of the GDPR). The data published is limited to the identity, professional contact details and institutional affiliation of the Member, as provided at the time of membership.

The directory is accessible only to other Members of the Association and shall not be used for commercial or promotional purposes. No transfer of data to third parties is carried out.

Each Member may, for reasons relating to their particular situation, object to the publication of their data in the directory by sending a request to: rgpd@sfcosmeto.fr. In such case, their information shall not appear in the online edition nor in future editions of the paper directory.

7. Transmission of membership

Membership may under no circumstances be transferred to a third party, for any reason whatsoever, directly or indirectly, in whole or in part, whether for consideration or free of charge.

8. Intellectual Property

Trademarks and Logo.

In accordance with the provisions of the French Intellectual Property Code, the unauthorised reproduction or use of the name “SFC”, its trademarks or its logo is strictly prohibited.

Content and Databases.

Any representation, reproduction, distribution, extraction or reuse, in whole or in part, by any means whatsoever, without the prior written authorisation of the SFC, constitutes an infringement liable to incur the civil and criminal liability of its author.

The use of information from the SFC’s databases, the Member Directory or online services for commercial, canvassing or solicitation purposes is strictly prohibited.

The databases created by the SFC, including in particular the Member Directory, scientific publications and content relating to events, are protected by Articles L.341-1 et seq. of the French Intellectual Property Code.

Any qualitatively or quantitatively substantial extraction or reuse of these databases without the prior written authorisation of the SFC is prohibited.

Any reproduction, imitation or use, in whole or in part, of the name “SFC”, its trademarks or logos, without authorisation, renders its author liable.

All elements accessible on the Website (graphic charter, texts, images, documents, publications, databases, Member Directory, content relating to events, etc.) are the exclusive property of the SFC or are subject to rights of use granted to it.

Mobile app.

When the SFC provides a mobile application in connection with its services (membership, events, Job Area, scientific content), these GTM also apply to its use.

The User undertakes to download the application exclusively from official platforms (App Store, Google Play) and to use it strictly in accordance with these terms.

The SFC shall not be held liable for the installation or use of modified, unofficial or unauthorised versions, nor for any direct or indirect damages that may result therefrom.

9. Force majeure

Force majeure means any unforeseeable, irresistible and external event within the meaning of Article 1218 of the French Civil Code, making it impossible for either party to perform its obligations.

The following events shall in particular be considered as such: natural disasters, fires, epidemics, administrative decisions, strikes or social unrest, interruptions of electronic communication networks, or any other event beyond the reasonable control of the SFC.

The performance of obligations is suspended for the duration of the force majeure event.

10. Applicable law, dispute, attribution of jurisdiction

These General Terms of Membership are governed by French law. Any dispute relating to their validity, interpretation or performance falls under the exclusive jurisdiction of the courts within the jurisdiction of the Paris Court of Appeal, subject to mandatory public policy provisions, in particular those applicable to consumers.
