This English version is provided for convenience only and is a non-official translation. In case of discrepancy or divergence, the French version (“Conditions Générales d’Utilisation de la Société Française de Cosmétologie”) shall prevail.

The French Society of Cosmetology (hereinafter the “SFC”), an association governed by the law of 1 July 1901, registered with the RNA under number W922001007 and whose registered office is located at 210 boulevard Bineau – 92200 Neuilly-sur-Seine, publishes and operates the website www.sfcosmeto.fr (hereinafter the “Website”).

The Website allows Users to access various services, including consulting news, registering for events, submitting offers or applications in the Job Area, as well as accessing information reserved for Adhering Members.

The purpose of these General Terms of Use (hereinafter the “Terms of Use” or “T&Us”) is to define the rights and obligations of all Users in the context of access to and use of the Website.

Acceptance of the Terms of Use is materialised by an online checkbox, not pre-checked, when creating an account or registering for a service. It also entails acknowledgement of the Privacy Policy, as well as, where applicable, the General Terms of Membership (GTM), the Internal Regulations and the Terms and Conditions of Events.

The version in force is the one published online on the date of consultation. In the event of a substantial change, Users will be informed by publication on the Website and, where applicable, by electronic notification.

Definitions

The updated version is available online and applies immediately upon publication.

For the purposes of these General Terms of Use, the following terms shall have the following meanings, whether used in the singular or plural:

  • “SFC”: the French Society of Cosmetology, an association governed by the law of 1 July 1901, represented by its President, having its registered office at 210 boulevard Bineau – 92200 Neuilly-sur-Seine.
  • “Website”: the www.sfcosmeto.fr website, owned by the SFC, as well as any digital platform made available for access to online services (registrations, memberships, Job Area, etc.).
  • “User”: any natural or legal person accessing the Website, whether or not they have a personal account.
  • “Adhering Member”: any natural or legal person who has subscribed to a membership of the SFC under the conditions set out in the General Terms of Membership (GTM), the Statutes and the Internal Regulations.
  • “Candidate User”: a User who submits a curriculum vitae (CV) or responds to a job offer through the Website.
  • “Recruiting User”: a User who submits a job, internship or work-study offer through the Website.
  • “Job Area”: the online service for connecting candidates and recruiters, allowing the temporary submission of CVs and offers. This data is kept only for the time necessary to establish the connection, and then deleted in accordance with the GDPR and the Privacy Policy.
  • “Event”: any scientific, institutional, professional or training event organised by the SFC, in person or remotely, accessible via the Website.
  • “Personal Data”: any information relating to an identified or identifiable natural person within the meaning of Regulation (EU) 2016/679 of 27 April 2016 (GDPR), collected and processed by the SFC in the context of the use of the Website.

ARTICLE 1: Creation of a personal account

The creation of a personal account is necessary to access certain services of the Website, in particular the Job Area, the Member Directory, registration for Events and access to information reserved for Adhering Members.

When creating the account, the User undertakes to provide accurate, complete and up-to-date information. Registration based on false, incomplete, unlawful information or a temporary e-mail address is prohibited.

Usernames and passwords are strictly personal and confidential. The User is solely responsible for their safekeeping and use. They undertake to change them regularly and to update them without delay in the event of loss, fraudulent use or suspicion of compromise.

The User must log out of their account at the end of each session. Any fraudulent or abusive use shall be the sole responsibility of the User.

The SFC reserves the right to suspend or deactivate an account in the event of non-compliance with these Terms of Use or after a period of inactivity of more than two years, in accordance with the data retention rules provided for by the GDPR and the Privacy Policy.

ARTICLE 2: Modification and lawfulness of information

The User is solely responsible for the information they enter and the content they publish or transmit through the Website.

They undertake to provide accurate, complete and regularly updated data. Any use of false information or intentional omission is the sole responsibility of the User.

In particular, the User shall refrain from:

  • publishing or transmitting content that is contrary to the law, public order, morality or the purposes of the SFC;
  • infringing the intellectual property rights or personality rights of third parties (image, privacy, personal data);
  • impersonating a third party or using false documents;
  • altering the proper functioning of the Website or diverting its functionalities from their purpose.

The SFC reserves the right to suspend or remove any non-compliant content, without prejudice to any disciplinary (termination of membership) or legal proceedings.

ARTICLE 3: Compliance with the standards in force

The Recruiting User undertakes to comply with all legal and regulatory provisions applicable to the dissemination of job offers, and in particular those relating to:

  • the protection of Personal Data (GDPR and French Data Protection Act);
  • the fight against discrimination (Labour Code and Criminal Code);
  • the fair and transparent information of candidates (Articles L.5331-2 and L.5331-3 of the French Labour Code).

When submitting job offers or CVs, the Recruiting User is solely responsible. They are also responsible for informing Candidate Users, in accordance with Articles 13 and 14 of the GDPR, of the use of their Personal Data in the context of the recruitment process.

ARTICLE 4: Obligation of the Recruiting User

By using the Job Area, the Recruiting User undertakes to:

  • publish only existing, available and French-language offers;
  • mention only criteria directly related to the position offered;
  • refrain from any discriminatory references prohibited by the Labour Code and the Criminal Code;
  • provide accurate and non-misleading information about the job offered, its remuneration and conditions;
  • comply with all applicable legal and regulatory obligations regarding recruitment and the protection of Personal Data.

The SFC reserves the right to refuse or delete, without compensation, any offer that does not comply with these Terms of Use or legal provisions. Offers are automatically deactivated after a period of two (2) months.

ARTICLE 5: Hypertext links and accessibility

Any hyperlink to the Website must be subject to prior written authorisation from the SFC, with the exception of links established to the home page, provided that they do not harm the image or interests of the association. The SFC reserves the right to request the immediate removal of any link it deems non-compliant.

The Website may contain hyperlinks to third-party sites. The SFC has no control over these sites and is not responsible for their content or terms of use. The User accesses them under their sole responsibility.

The User is informed that the quality of display, navigation and operation of the Website may vary depending on the hardware, operating system, configuration or connection network used.

The SFC makes every effort to ensure optimal accessibility of the Website, but cannot be held responsible for difficulties of access or use related to unsuitable equipment, technical limitations of electronic communication networks or the intervention of third-party service providers.

Article 6: Personal data

The SFC, acting as Data Controller, collects and processes Personal Data in the context of membership, use of the Website, the Job Area and registration or participation in Events.

Personal Data is processed in accordance with Regulation (EU) 2016/679 of 27 April 2016 (GDPR), Law No. 78-17 of 6 January 1978 as amended, and the SFC Privacy Policy, accessible at any time via the Website.

Each User, Adhering Member or Participant has the rights of access, rectification, erasure, restriction, objection and portability of their data, as well as the right to define directives regarding their fate after death.

ARTICLE 7: Responsibility of the User of the Website and the Job Area

The User undertakes to use the Website and the services offered by the SFC, including the Job Area and the Member Directory, in compliance with these Terms of Use, the SFC’s Statutes and applicable regulations.

The User is solely responsible for the data and content they put online.

The User undertakes to use the Member Directory and the Job Area exclusively for associative and scientific purposes, in accordance with the General Terms of Membership and the Privacy Policy. Any use for commercial, prospecting or canvassing purposes is strictly prohibited.

The User shall indemnify and hold harmless the SFC against any action, claim or judgment resulting from a breach of their obligations or the dissemination of unlawful or inappropriate content.

The SFC reserves the right to delete, without notice, any content that does not comply with these Terms of Use and to suspend or delete the User’s account, in accordance with the Statutes.

In the event of a complaint or claim from a third party concerning data or content posted online by a User, the User must immediately provide the SFC with all useful explanations and supporting documents and assume the legal consequences, including criminal consequences, that may result.

ARTICLE 8: Intellectual property

The User shall refrain from:

  • infringing SFC’s intellectual property rights, whether trademarks, copyright, or any other protected rights;
  • infringing the personality rights of persons with whom they may have a relationship through the Website;
  • publishing or transmitting content that is unlawful or inappropriate with regard to the purposes of the services offered;
  • copying, downloading, duplicating or reproducing all or part of the content of the Website without authorisation;
  • affecting the proper functioning of the Website;
  • using automated processes to respond massively to offers published on the Website;
  • circumventing technical protection systems, carrying out or inciting acts of piracy;
  • impersonating a third party;
  • misusing or attempting to misuse any functionality of the Website.

All content of the Website is protected by French law and international conventions on copyright and intellectual property.

The general structure, texts, images, logos, graphic elements, databases, as well as all the software and developments of the Website, are the exclusive property of the SFC and are protected by the French Intellectual Property Code.

Any representation, reproduction, translation, adaptation or distribution, in whole or in part, on any medium whatsoever, without the express prior authorisation of the SFC, constitutes an infringement punishable under Articles L.335-2 et seq. of the Intellectual Property Code.

Similarly, any substantial extraction or reuse of the Website’s database, including the Member Directory and the Job Area, without prior authorisation from the SFC, is punishable under Articles L.343-1 et seq. of the Intellectual Property Code.

Any total or partial reproduction of the trademarks, logos or other distinctive signs of the SFC, as well as any use of these elements without express authorisation, is prohibited.

The authors of scientific contributions or content published on the Website retain their intellectual property rights. However, they grant the SFC, on a non-exclusive basis, a limited right of use allowing their dissemination on the Website and in the association’s institutional communications. The author may at any time request the withdrawal or modification of their contribution by contacting the SFC.

ARTICLE 9: Liability

The User acknowledges that they use the Website and its services under their sole responsibility.

The SFC implements all appropriate technical and organisational measures to ensure the security, confidentiality and availability of the Website and the Personal Data processed therein, in accordance with Article 32 of the GDPR.

However, the SFC cannot be held liable for:

  • interruptions in access linked to the Internet network or its technical service providers, unless there is proven fault on its part;
  • indirect damages, such as loss of profits, customers, data or business;
  • fraudulent use by a third party of a User’s identifiers;
  • the content or operation of third-party sites accessible via hyperlinks from the Website.

The liability of the SFC is limited to proven direct damages and shall in no case extend to indirect damages, including loss of opportunity, loss of clientele or loss of data.

In accordance with its Statutes, the SFC is represented in court by its President, who may take any action necessary to defend its interests.

The SFC does not guarantee that the Website is free of errors, omissions or occasional service interruptions and cannot be held responsible for the consequences resulting from inaccurate or incomplete information published on the Website.

ARTICLE 10: Applicable law – Competent jurisdiction

These General Terms of Use are governed by French law. Any dispute relating to their validity, interpretation or performance falls under the exclusive jurisdiction of the courts within the jurisdiction of the Paris Court of Appeal, except for mandatory provisions of public policy, in particular those applicable to consumers.
